Terms of sale
ARTICLE 1. PRODUCTS
1.1. Product Characteristics
The Products offered for sale by the Company are those displayed on the Website on the date it is consulted by the Customer. The product description published on the Website at the time the order is placed shall prevail.
Each Product is accompanied by a detailed product page setting out its essential characteristics (including the unit price, available sizes and colours, composition, geographical traceability of the three main stages of manufacture [weaving/knitting, dyeing/printing, and garment assembly], as well as any specific features) and includes one or more photographs of the Product.
Customers are invited to consult the product page of each Product to familiarise themselves with its properties and characteristics, particularly in order to determine whether it meets their needs. The selection and purchase of a Product remain the sole responsibility of the Customer.
Products are described and presented as accurately as possible. Although the Company makes every effort to ensure that the colours and patterns displayed on the Website faithfully represent the original Products, slight differences may occur, particularly due to screen resolution and colour settings. Consequently, the Company cannot be held liable for minor differences between the photographs displayed on the Website and the actual Products.
The Company undertakes to deliver Products that comply with applicable health and safety requirements and with European regulations, including legislation relating to regulated chemical substances.
1.2. Product Availability
Products are offered for sale subject to availability.
Information regarding Product availability is provided on the Product page and during the ordering process. The Company makes every effort to ensure that availability information is regularly updated.
However, despite all precautions taken, a Product may exceptionally become unavailable after an order has been placed. In such a case, the Company will immediately inform the Customer and, where applicable, refund the amount paid for the unavailable Product(s) together with any related delivery charges using the same payment method used for the purchase.
The Company shall not be liable for the unavailability of one or more Products on the Website.
The Company reserves the right to modify the range of Products offered on the Website at any time and without prior notice.
ARTICLE 2. PRODUCT PRICES
2.1. Price Information
The prices of Products are those displayed on the Website on the date the order is placed.
Prices are shown inclusive of all taxes but exclusive of delivery charges.
Delivery charges vary according to the delivery method selected and are communicated to the Customer in the order summary before final validation of the order. Delivery charges are expressed inclusive of all taxes.
2.2. Display of Prices
All prices displayed on the Website are shown in Euros (€).
In the event of an obvious pricing error, including a manifestly incorrect or negligible price, regardless of the cause (including a technical issue, software bug, manual error or system malfunction), the order may be cancelled even if it has already been confirmed by the Company. The Customer will be informed as soon as possible.
In such circumstances, and subject to Product availability, the Customer may place a new order at the corrected price.
As part of promotional campaigns organised by the Company, discounted prices may be displayed using a crossed-out reference price. Such reference prices are calculated based on the selling price applied during the thirty (30) days preceding the relevant promotional operation.
2.3. Price Changes
The Company reserves the right to modify Product prices at any time and without prior notice.
However, the prices applicable to a Product are those in effect on the date the order is placed.
ARTICLE 3. E-GIFT CARD
The Website offers Customers the possibility of purchasing or offering a PABLO E-Gift Card through the "E-Gift Card" section.
The Customer is invited to:
• Select one of the available amounts offered on the Website: €50, €100, €150, €200, €250, €300, €350, €400, €450 or €500;
• Enter the recipient's name (either their own or that of a third party);
• Add an optional personal message for the recipient, it being understood that the Customer remains solely responsible for any text submitted and undertakes not to include content that violates applicable laws, public order or accepted standards of decency;
• Enter the recipient's email address;
• Select the delivery date of the E-Gift Card, with the option to print it or receive it by email.
Once these details have been completed, the Customer must click the "Add to Cart" button and follow the ordering procedure described in Article 4.2 below.
The E-Gift Card will be sent automatically and exclusively by email to the email address provided by the Customer for the recipient.
The E-Gift Card is not issued in a specific person's name. Its holder is solely responsible for its use.
The E-Gift Card is valid for twelve (12) months from the date it is sent to the recipient's email address.
It may only be used on the Website.
The E-Gift Card may be used to pay for all or part of purchases made on the Website. It may be used on one or several occasions within the limits of the available balance and validity period.
If the available balance is insufficient to cover the full amount of an order, the Customer must pay the remaining balance using another payment method accepted on the Website.
The holder of the E-Gift Card may check the remaining balance at any time via the link provided in the email sent with the E-Gift Card.
The E-Gift Card cannot be reloaded, exchanged, transferred, resold or refunded, whether in whole or in part, for any reason whatsoever (including loss, theft or expiry).
The E-Gift Card may not be used to purchase another E-Gift Card.
If an order paid in whole or in part with an E-Gift Card is refunded, the E-Gift Card holder will be credited with the refunded amount in the form of a new E-Gift Card valid for a further twelve (12) months.
ARTICLE 4. IN-STORE RESERVATIONS AND ORDERS
The Website allows Customers to place an order or reserve a Product in store.
4.1. Reserve a Product in Store
Customers are invited to review SOCLOZ's Terms and Conditions of Use, which govern the conditions under which the online reservation service may be used.
4.2. Orders
4.2.1. Ordering Procedure
The Customer places an order by following the steps below:
STEP 1 – PRODUCT SELECTION
The Customer is invited to select the Product(s) they wish to purchase, including any relevant options (such as colour and size), specify the desired quantity, and add them to the shopping cart by clicking the "Add to Cart" button.
The "Cart" icon displayed in the top-right corner of the screen indicates that the selected Product(s) have been added and displays the number of items currently in the cart.
The Customer may review the contents of the cart at any time by clicking on the Cart icon. At this stage, the Customer may freely verify the details of the selected Products, correct any errors, remove Products, adjust quantities, or add additional Products.
STEP 2 – CART VALIDATION
To validate the selected Products and proceed with the order, the Customer must click the "Checkout" button.
Once the cart has been validated, the Customer may choose one of the following options to complete the order:
• Sign in by clicking the "Log In" button and entering their email address and password to place the order through their customer account. Customers may also sign in using their Facebook or Google account.
• Continue as a guest, without creating a customer account.
• Create a customer account.
To create a customer account, the Customer must provide the following information before clicking the "Create Account" button:
a) Title
b) First name
c) Last name
d) Telephone number
e) Email address
f) Password
The Customer may also choose to subscribe to newsletters from the Company and the GERARD DAREL Group and receive related communications.
Creating a customer account allows the Customer to update and complete personal information, review order history, request returns, and download invoices.
Customer accounts are strictly personal. The Customer undertakes to keep account credentials secure and not disclose them to third parties.
The Customer must immediately notify the Company if they become aware of any unauthorised or fraudulent use of their account.
In the event of loss or theft of a password, the Customer may request a new password from the Company.
Depending on the option selected by the Customer:
• Ordering through an existing customer account:
If a delivery address has already been saved in the Customer's profile, it will automatically be proposed as the shipping address. The Customer may select another address from the "Saved Addresses" menu.
• Creating a customer account:
The Customer must provide delivery information, including delivery country, first and last name, address and telephone number. The Customer may choose to save this information for future orders.
• Continuing as a guest:
The Customer must first provide an email address in the "Contact" section before entering delivery information, including delivery country, first and last name, address and telephone number. The Customer may also choose to save this information for future orders.
The Company cannot be held liable for inaccurate information provided by the Customer.
Customers are invited to consult the Privacy Policy and Cookie Policy for further information regarding the processing of personal data.
Before proceeding, the Customer must explicitly review and accept the Terms and Conditions and Privacy Policy by ticking the box stating:
"I accept the Terms and Conditions of Sale and the Privacy Policy."
Only after accepting these documents may the Customer continue by clicking the "Continue to Shipping" button.
STEP 3 – DELIVERY METHOD SELECTION
The Customer must select a delivery method.
At this stage, the estimated delivery time (in business days) and the cost of each available delivery option are displayed.
Available delivery methods vary depending on the delivery address provided by the Customer.
For deliveries within mainland France, Corsica and Monaco, the Customer may choose either home delivery or delivery to a pickup point via our partner Colissimo.
If delivery to a pickup point is selected, the Customer must choose the desired pickup location by clicking "Choose My Pickup Point."
Once the delivery method has been selected, the Customer may proceed by clicking "Continue to Payment."
STEP 4 – PAYMENT
The Customer is invited to select one of the following payment methods:
• Credit Card / Debit Card
The Website accepts Carte Bleue, Visa®, MasterCard® and American Express® cards.
The Customer must provide:
-
Card number
-
Cardholder's name
-
Expiry date
-
Security code (CVV)
For American Express cards, the Customer must provide the four-digit security code.
Authorisation to charge the card is requested at the time the order is confirmed on the Website, except in the event of temporary server unavailability.
The Company reserves the right to submit a new authorisation request if the initial request could not be processed due to technical issues.
The Company implements all necessary measures to ensure the confidentiality and security of payment information transmitted through the Website.
The Website uses secure online payment technology that encrypts Customer data.
Payment information is transmitted according to the highest security standards.
Payment processing is provided by Shopify. As Shopify acts solely as a technical service provider, disputes relating to orders are handled directly by the Company or, where applicable, by the Customer's bank.
All information exchanged for payment processing purposes is encrypted using SSL (Secure Socket Layer) technology. Such information cannot be detected, intercepted or used by third parties.
At no time does the Customer's financial information pass through the Company's own information systems.
Shopify verifies that the connection between the Customer's browser and the payment platform is secure before transmitting payment information to the banking institution responsible for processing the transaction.
In accordance with Article L.221-11 of the French Consumer Code, the Customer will receive written confirmation of the amount paid for each Product, including a breakdown of Product prices and any delivery charges, no later than the time of delivery.
• PayPal
If this payment method is selected, the Customer will automatically be redirected to the PayPal platform.
If the Customer does not already have a PayPal account, one may be created during the process.
The terms and conditions applicable to PayPal transactions are those established by PayPal.
Once the payment has been validated through PayPal, the Customer will be redirected to the Website's order confirmation page.
• Google Pay
Customers may complete their purchase using Google Pay in accordance with Google's applicable terms and conditions.
• E-Gift Card
The Customer may enter the E-Gift Card number in the dedicated payment field during checkout.
If the balance available on the E-Gift Card is insufficient to cover the full amount of the order, the remaining balance must be paid using another payment method accepted by the Website.
Customers are invited to refer to Article 3 regarding E-Gift Cards.
The Customer guarantees that they have all necessary authorisations to use the selected payment method.
At this stage, the Customer may also enter a promotional code and specify a billing address, which may be identical to or different from the delivery address.
Once all required payment information has been entered, the Customer may complete the order by clicking the "Confirm Payment" button.
In the event of payment failure, incorrect billing information or any payment-related issue attributable to the Customer, the Company reserves the right to suspend the order until the issue has been fully resolved.
4.2.2. Order Confirmation
As soon as payment has been successfully accepted, the Customer will receive an order confirmation email summarising the essential details of the order, including:
-
Order number
-
Ordered Products
-
Total amount paid
-
Billing and delivery addresses
-
Estimated delivery date
The email will also contain, or allow the Customer to download or print, a copy of these Terms and Conditions. If this is not possible, the Customer is invited to contact Customer Service.
The validation of the order by the Customer and the order confirmation sent by the Company constitute the conclusion of a binding sales contract and full acceptance of these Terms and Conditions.
The Customer expressly agrees to the use of email as a means of communication for order confirmation.
The Company recommends that Customers retain a copy of the order summary in electronic form.
As some emails may be filtered as spam, Customers are advised to check their spam or junk mail folder if they do not immediately receive their confirmation email.
The Company reserves the right not to accept an order for legitimate reasons, including but not limited to:
• Previous abusive complaints;
• Abnormally large quantities ordered;
• Previous abusive returns or exchanges;
• Existing disputes with the Customer.
PABLO Customer Service is available to answer any questions relating to orders.
Customer Service can be contacted:
• By email: eshop@pablo.fr
• By telephone: +33 (0)1 80 49 12 12
Monday to Friday from 9:00 a.m. to 1:00 p.m. and from 2:00 p.m. to 6:00 p.m. (excluding public holidays)
• Or through any other contact methods available on the "Contact Us" page.
4.2.3. Order Archiving
Order confirmations are recorded in PABLO's records and stored on a reliable and durable medium.
The Customer agrees that these records constitute proof of the contractual relationship between the parties.
In accordance with Article L.213-1 of the French Consumer Code and Decree No. 2005-137 of 16 February 2005, where an order amount is equal to or greater than €120, the Company retains records relating to the order for a period of ten (10) years.
These records may be made available to the Customer upon request sent to eshop@pablo.fr.
The Company also recommends that Customers keep their own copy of all order-related documents in electronic and/or paper format.
ARTICLE 5. RETENTION OF TITLE
The Products ordered shall remain the exclusive property of the Company until full payment of the purchase price has been received by the Company.
ARTICLE 6. DELIVERY
6.1. Delivery Methods
6.1.1. Home Delivery
Products purchased on the Website may only be delivered to the countries listed when the Customer enters a shipping address during the checkout process.
Orders cannot be placed for delivery addresses located outside the countries available on the Website.
Products will be delivered exclusively to the delivery address provided by the Customer at the time of the order.
Once the order has been confirmed by the Company, the delivery address can no longer be modified.
6.1.2. Pickup Point Collection (Mainland France, Corsica and Monaco only)
For deliveries within mainland France, Corsica and Monaco, the Company offers Customers the possibility of collecting their order from one of the pickup points available on the Website.
The Product will be made available at the selected pickup point within the timeframe communicated by the Company and, in any event, no later than thirty (30) days from the date of the order, provided that full payment has been received.
As soon as the order is available for collection, the Customer will be notified by email.
The Customer then has ten (10) business days to collect the order from the selected pickup point.
To collect the order, the Customer must present:
• The collection notification email;
• A valid form of identification.
The Customer's identity will be verified before the order is handed over.
If the order is not collected within ten (10) business days from the date on which the collection notification was sent, the sale will automatically be cancelled and the Customer will be refunded the purchase price.
6.2. Delivery Charges
Standard home delivery and pickup point delivery within mainland France are offered free of charge by the Company.
Delivery charges for French overseas territories and all other destinations are payable by the Customer.
For destinations where delivery charges apply, the amount varies depending on the selected delivery method and destination.
The applicable delivery charges are displayed and communicated to the Customer throughout the checkout process.
Available delivery methods vary depending on the delivery address.
6.3. Delivery Times
The Company makes every effort to ensure that orders are delivered within the estimated delivery times communicated to the Customer.
If, for any reason, the Company is unable to meet the announced delivery timeframe, the Customer will be informed and may either:
• Accept the new proposed delivery date; or
• Cancel the order without charge or penalty.
In the latter case only, the Customer will be refunded the full amount of the order.
If the billing information provided by the Customer is incomplete or incorrect, the Company may request additional information, which may extend delivery times without giving rise to any liability on the part of the Company.
Customers are also informed that during periods of exceptionally high activity, including sale periods, year-end holidays or outlet events, order preparation times may be extended.
In such circumstances, shipment may be delayed by up to one additional week.
The Company will make every effort to minimise delays and thanks Customers for their understanding.
Delivery is deemed completed:
• Upon signature of the delivery receipt by the Customer or any third party designated by the Customer at the delivery address specified in the order; or
• When the Products are made available at the pickup point selected by the Customer for deliveries within mainland France, Corsica and Monaco.
6.4. Delivery Issues
Any failure to deliver, or any delay exceeding the delivery period communicated by the Company (and in any event exceeding thirty (30) days), must be reported as soon as possible to eshop@pablo.fr.
In such circumstances, the Customer may request either:
• A new delivery date; or
• Cancellation of the order.
In all cases, the Company shall not be liable for any delay or failure to deliver caused by a force majeure event as defined in Article 12 of these Terms and Conditions.
If delivery cannot be completed due to circumstances attributable to the Customer, including an incorrect delivery address, the Company reserves the right, at its sole discretion, to cancel the order after thirty (30) days from the originally scheduled delivery date.
In such cases, the Company also reserves the right to charge the Customer for any additional transport costs resulting from the failed delivery.
ARTICLE 7. RECEIPT OF PRODUCTS
Risk relating to the Products transfers to the Customer when the Customer takes physical possession of the Products.
The Customer is responsible for checking both the quantity and the apparent condition of the Products upon delivery.
If the parcel is open, visibly damaged, or if any Product is damaged, missing or does not correspond to the order, the Customer is invited to notify the Company within forty-eight (48) hours by contacting:
• +33 (0)1 80 49 12 12
(Monday to Friday, 9:00 a.m. to 1:00 p.m. and 2:00 p.m. to 6:00 p.m., excluding public holidays)
• Or through any other contact methods available on the "Contact Us" page.
This notification allows the Company to investigate the matter with the carrier and, where applicable, pursue any available remedies within the applicable legal time limits.
In the event of missing Products, refusal of delivery or return of Products under the circumstances described above, the Company will reimburse the relevant Product(s) after receiving the returned parcel and completing the necessary verification procedures.
These provisions do not affect the Customer's statutory right of withdrawal described in Article 8 below.
ARTICLE 8. RIGHT OF WITHDRAWAL / RETURNS
In accordance with applicable legislation, and in particular Articles L.221-18 to L.221-28 of the French Consumer Code, the Customer has a period of fourteen (14) days following receipt of the Product to exercise their right of withdrawal without having to provide any reason and without incurring penalties.
The Company extends this statutory period by sixteen (16) additional days, allowing Customers to exercise their right of withdrawal within thirty (30) days from the date of receipt of the Products.
Where an order contains multiple Products delivered separately, or where delivery takes place in several instalments, the withdrawal period begins upon receipt of the final Product or instalment.
To exercise their right of withdrawal and return a Product, Customers are invited to follow the procedure described in the Website's FAQ.
Following notification of withdrawal, the Customer has fourteen (14) days to return the relevant Product(s).
The Company extends this statutory return period by sixteen (16) additional days, allowing Products to be returned within thirty (30) days of the withdrawal notification.
Products must be returned:
• In their original packaging;
• With all accessories;
• In a condition allowing immediate resale.
The Customer may be held liable for any loss in value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the Product.
Products must be returned to:
SED LOGISTIQUE
PABLO – Zone de Moimont – SED Bat B2 – Quai 93/94
1 rue Jean Jaurès
95670 MARLY LA VILLE
France
Return shipping costs are borne by the Company only for orders delivered within mainland France.
If the Customer chooses not to use the prepaid return label provided by the Company, return shipping costs remain the Customer's responsibility.
For orders delivered outside mainland France, return shipping costs are always borne by the Customer.
The Customer bears all risks associated with returning Products.
Customers are advised to retain proof of shipment until the refund has been processed.
Subject to compliance with the above conditions, the Company will reimburse the VAT-inclusive purchase price of the returned Product(s).
Where delivery charges were included in the order, reimbursement will be limited to the cost of standard delivery.
Refunds will be processed within fourteen (14) days from the date on which the Company is informed of the withdrawal.
However, reimbursement may be postponed until the Company has received the returned Products or until the Customer has provided proof of shipment, whichever occurs first.
Refunds will be made using the same payment method originally used for the purchase.
Where payment was made using an E-Gift Card, the refunded amount will be credited back to a new E-Gift Card valid for twelve (12) months.
The right of withdrawal does not apply to the contracts listed in Articles L.221-2 and L.221-28 of the French Consumer Code, including in particular:
• Fully performed services where performance began with the Customer's prior express consent and express waiver of the right of withdrawal;
• Products made to the Customer's specifications or clearly personalised;
• Products liable to deteriorate or expire rapidly;
• Sealed Products that have been unsealed after delivery and cannot be returned for health protection or hygiene reasons;
• Products which, after delivery, have become inseparably mixed with other goods by their nature.
ARTICLE 9. LEGAL WARRANTIES
Products sold by the Company are covered by:
• The legal warranty of conformity provided for under Articles L.217-1 to L.217-32 of the French Consumer Code;
• The legal warranty against hidden defects provided for under Articles 1641 to 1648 of the French Civil Code.
If the Customer identifies a lack of conformity and/or a hidden defect, they must inform the Company as soon as possible using one of the contact methods specified in the preamble to these Terms and Conditions.
The Company will then provide the Customer with instructions regarding the return procedure.
9.1. Legal Warranty of Conformity
The Company undertakes to deliver Products that comply with the contract and are free from conformity defects at the time of delivery.
Products must be fit for the purposes ordinarily expected of similar goods and possess the characteristics described at the time of sale.
The Company is also responsible for conformity defects resulting from packaging, assembly instructions or installation where installation was carried out by the Company or under its responsibility.
Under the legal warranty of conformity, the Customer:
• Benefits from a period of two (2) years from delivery of the Product to invoke the warranty.
• Is not required to prove the date on which the defect appeared, as defects arising during this period are presumed to have existed at the time of delivery unless proven otherwise.
The Customer may choose:
a) Repair of the Product
In the event of repair, the Customer benefits from an additional six (6) months of warranty coverage following completion of the repair.
OR
b) Replacement of the Product
In the event of replacement, the replacement Product benefits from a new two-year legal warranty period.
However, if one of these remedies is impossible or would impose a manifestly disproportionate cost on the Company within the meaning of Article L.217-22 of the French Consumer Code, the Company may choose the alternative remedy.
Repair or replacement must take place within a maximum period of thirty (30) days following the Customer's request.
Alternatively, if:
• The Company refuses to bring the Product into conformity;
• Conformity is not restored within thirty (30) days;
• The lack of conformity is particularly serious; or
• Attempts to restore conformity have failed,
the Customer may:
• Return the Product and obtain a full refund;
OR
• Keep the Product and obtain a partial refund.
Any refund, whether total or partial, will be issued within fourteen (14) days following the Customer's request.
The Customer may also request a price reduction or immediate termination of the contract where the lack of conformity is sufficiently serious to justify such measures without first requesting repair or replacement.
The Customer may not terminate the sale if the lack of conformity is minor.
Any period during which the Product is unavailable due to repair or replacement suspends the running of the warranty until the repaired or replacement Product is delivered.
Repair, replacement or reimbursement will be carried out free of charge for the Customer and does not prevent the Customer from claiming damages where legally entitled to do so.
The Customer may bring proceedings before the French courts within five (5) years from the discovery of the defect if the Company has failed to satisfy their claim.
The rights described above arise from Articles L.217-1 to L.217-32 of the French Consumer Code.
A seller who deliberately obstructs the implementation of the legal warranty of conformity may be subject to a civil fine of up to €300,000, which may be increased to up to 10% of average annual turnover (Article L.241-5 of the French Consumer Code).
9.2. Legal Warranty Against Hidden Defects
The Company undertakes to deliver Products free from hidden defects (defects not apparent at the time of purchase) that would render them unfit for their intended use or significantly diminish their usefulness to such an extent that the Customer would not have purchased them, or would have paid a lower price, had they been aware of the defect.
To invoke the legal warranty against hidden defects, the Customer must demonstrate that:
a) The Product contains a defect that was not apparent at the time of purchase;
b) The defect renders the Product unfit for its intended use or significantly reduces its usefulness;
c) The defect existed at the time of purchase.
The Customer benefits from a period of two (2) years from discovery of the defect to invoke this warranty.
It should be noted that the defect may be discovered up to twenty (20) years after the original purchase.
The Customer may choose:
a) To return the Product and obtain reimbursement of the purchase price together with any costs arising from the sale;
OR
b) To keep the Product and obtain a partial refund of the purchase price.
ARTICLE 10. INTELLECTUAL PROPERTY RIGHTS
The Customer acknowledges and agrees that all copyrights, trademarks, and other intellectual property rights, whether registered or unregistered, relating to all information, content, and materials appearing on the Website are, at all times, the property of the Company, any other company belonging to the GERARD DAREL Group, or third parties who have granted a licence to the Company and/or another company of the GERARD DAREL Group.
Accordingly, the Customer undertakes not to extract, reproduce, represent, copy, distribute, modify, or otherwise infringe such rights or any part of the Website.
ARTICLE 11. PERSONAL DATA PROTECTION – COOKIES
As part of the Customer's use of the Website, the Company may collect and process personal data.
The Privacy Policy and Cookie Policy form an integral part of these Terms and Conditions and explain how the Company collects, processes and protects personal data and uses cookies.
These policies are available on the Website under the sections "Privacy Policy" and "Cookies."

ARTICLE 12. FORCE MAJEURE
In the event of a force majeure event within the meaning of Article 1218 of the French Civil Code, the effects of the sales contract shall be suspended.
The Company may, at its sole discretion, cancel the order without incurring any liability.
In such circumstances, the Company will reimburse the Customer for the purchase price and any delivery charges paid.
Under no circumstances shall the Company be liable for any damages resulting from such force majeure events.
ARTICLE 13. VALIDITY OF THE TERMS AND CONDITIONS
If any provision of these Terms and Conditions is declared wholly or partially invalid under applicable law, regulation, or a final decision of a competent court, the remaining provisions and rights and obligations arising from these Terms and Conditions shall remain valid and enforceable.
ARTICLE 14. COMPLAINTS – DISPUTE RESOLUTION – MEDIATION
For any complaint and/or dispute relating to the Website, these Terms and Conditions and/or an order, the Company invites the Customer to contact Customer Service:
By telephone:

(excluding public holidays)
By email:
Or through any other contact methods available on the Website's "Contact Us" page.
If no amicable solution can be reached with Customer Service, the Customer may submit the dispute to the consumer mediator with whom the Company has entered into an agreement.
In accordance with Article L.612-1 of the French Consumer Code:
"Every consumer has the right to use a consumer mediator free of charge with a view to the amicable resolution of a dispute with a professional."
Disputes falling within the scope of Article L.612-1 include contractual disputes relating to the performance of a sales or services contract between a consumer and a professional.
This mediation process covers both domestic and cross-border disputes.
The Customer may submit a request to the mediator:
By post:
CM2C
Centre de la Médiation de la Consommation de Conciliateurs de Justice
4 Rue Saint-Jean
75017 Paris
France
By email:
After a prior written complaint has been submitted to the Company, CM2C may be contacted for any consumer dispute that remains unresolved.
The Customer remains free to accept or refuse mediation. Likewise, where mediation takes place, each party remains free to accept or reject the solution proposed by the mediator.
If no amicable solution or mediation agreement is reached, French courts shall have jurisdiction over disputes arising from these Terms and Conditions, subject to any mandatory legal provisions requiring jurisdiction elsewhere. Nothing in these Terms and Conditions prevents the Customer from bringing proceedings before another competent court where permitted by applicable law.
ARTICLE 15. GOVERNING LAW
These Terms and Conditions are governed by French law.
The United Nations Convention on Contracts for the International Sale of Goods (Vienna Convention) shall not apply.
However, nothing in these Terms and Conditions shall deprive any Customer of the protection afforded by the mandatory provisions of the laws of their country of habitual residence.
